There appear to be rumors circulating in the offshore industry about New Zealand Finance Companies possibly being subject to new regulatory requirements. We wish to clarify that Finance Companies which are not offering services to residents of New Zealand are not subject to the new regulations for non bank deposit takers. Such regulations adopt the same geographical scope as the Securities Act 1978. To be subject to the non-bank deposit taking regime you would have to offer services to the public in New Zealand.
